Even though this provision goes into effect October 6
, the Bureau of Labor and Industries will not be enforcing this provision until January 1, 2019 and individuals will not be able to bring private rights of action until January 1, 2024. That being said, as of October 6
, it will be an unlawful employment practice to attempt to obtain salary history information, so employers should take steps now to ensure compliance with this new law.
We recommend a review of recruiting policies and practices for both employers in Oregon and those who recruit for employees that will be working in Oregon.
Employers should remove any reference to salary history information from their employment applications and interview questions. Employers should also make sure everyone involved in the recruitment process is aware of the requirements of this law.
